William Carpenter, one of the oldest residents of this city, was stricken by paralysis last Friday evening, at this home on Elm near Thomas street, from the effects of which he died.  His age was about 69 years.
The funeral took place Monday afternoon under the direction of Rowena Lodge K. of P., of which deceased was a member.  - New Albany Public Press 07 June 1899

Death Record clearly gives year of birth as 1862; however, this appears unlikely. The 1900 census gives year of birth as 1854, which is more likely as she married William T. Brown 12 Jan 1873. Hattie married Edward N. Shrader 25 Sep 1884 in Louisville, KY. She married John M. Treber (12 years her junior) 28 Jun 1893 in New Albany, IN. Daughters Maggie Brown and Edna Shrader appeared on the 1900 census with Hattie and their stepfather.

Mrs. Hattie Treber, aged 52 years, died Jan. 2d at her home, 216 East High street, suddenly of hemorrhage of the lungs. She leaves a husband and five children, two sons, Wm. Brown, who is in the West and Theodore Brown, in Oklahoma City; the daughters are Mrs. Harry Plaiss, Mrs. John Hobson, and Miss Isabelle Treber, of this city. Her mother, Mrs. Wm. "A Horrible Fratricide. Berry Carpenter Shoots and Instantly Kills His brother Lee Carpenter. The Murderer Charged with the Seduction of His Own Daughter. Two Hundred People in Pursuit of Carpenter and Threaten to Hang Him...

"Parties reached the city about noon today from Harrison county, bringing partial particulars of one of the most shocking murders that has occurred in this part of the state in many years. Berry Carpenter and Lee Carpenter are brothers. They are farmers and reside in Posey township, Harrison county, between Bridgeport and Elizabeth. They are both brothers of William Carpenter, ex-chief of police and half-brothers of Capt. Ad. Carpenter, of this city. Berry Carpenter, by his bad life, had sunk to the lowest scale in public estimation, while Lee Carpenter was a most excellent man and citizen, and highly respected by all who knew him for his industrious habits and upright life. Both were farmers...

"Berry Carpenter's habits of indolence were such that his brother Lee was compelled to assist in supporting his family. He was indeed, the chief support of Berry's children, being a man of great kindness of heart. Some slight difficulty, it is said, had occurred between the brothers in relation to the small sum of two dollars claimed by one of them to be due from the other; but there is no probability that the fratricide that followed grew out of this; for behind all other matters there was one that was, if true, as deeply grievous as the murder itself. It was of common report that Berry Carpenter was living in incest with his daughter, and that she had lately become a mother from this incestuous, unnatural intimacy. Parties who arrived in the city this afternoon saw that this morning, about 8 o'clock, Lee Carpenter met his brother Berry and commenced talking about this infamous charge against him, and that in the course of the conversation remonstrated strongly against the degradation he had fallen into and into which he had dragged his own child. Berry Carpenter, lost to all fatherly affection as well as to all fraternal instincts, the informants state, drew his pistol and with the coolest deliberation fired its contents into the body of the brother killing him instantly...

"The bloody fratricide then fled. The news of the cold-blooded murder spread like wild-fire through the neighborhood, causing the most intense excitement and the deepest feeling of indignation among the people. The murderer started in the direction of New Albany when he left the scene of his deadly work. Soon after the killing runners started out in all directions to give alarm, and by 11 o'clock, it is stated at least two hundred people were scouring the woods and hills and fields in all directions in search of the murderous wretch. A brother-in-law of the murdered man came to his city and informed the officers of the crime, for the purpose of invoking their aid in the capture of the criminal. The police force was so disposed throughout the city as that they might be most likely to discover Carpenter if he came here, but their opinion i that he either made for the Ohio river, with the ope of escaping into Kentucky in a skiff, or moved off the direction of Washington or Crawford counties where he could easily hide himself among the hills. Parties from the scene of the murder say if Carpenter is caught he will be hanged from the nearest tree, as the excitement against him is so intense as to leave no doubt of a resort to lynch law. While such an act as this on the part of the citizens would be deplored by all law-loving and law-obeying citizens, and should not be resorted to, it is likely the fate of Berry Carpenter will be speedily sealed if he is caught by the citizen living in the neighborhood of this awful crime...

"The murdered man leaves a wife and large family of children, who are plunged into the most intense grief over his sudden and terrible taking off. Lee Carpenter was between forty and forty-five years old, and in his death Harrison county ha lost a most excellent citizen, and his family a kind and most indulgent husband and father. No vigilance will be omitted in the effort to capture his murderer. Probably a suicide. Berry Carpenter's acquaintances in this city believe that he will never be taken alive. He is a desperate man, and they believe he secreted himself somewhere in the hills and committed suicide after realizing the enormity of the crime he had been guilty of." [1]

New Albany Daily Ledger Standard; Friday, June 10, 1881, New Albany Indiana.

"The Carpenter Fratricide. Further Particulars of the Fearful Crime. The Murdered Man's Son a Witness of the Bloody Affair. The Murderer Secreted for Three Hours in New Albany. then Walks Away and Escapes Arrest....The talk of the city yesterday afternoon and today was and is the killing of Lee Carpenter by his brother Berry Carpenter, and all the detail of the awful crime are sought for with avidity. A correspondent at Corydon furnishes the Ledger-Standard with the following statement of the killing: "An old grudge existed between Lee Carpenter and Berry Carpenter, brothers, who resided in Posey township, Harrison county, near Boner's mill. About 8 o'clock Thursday morning, Lee Carpenter was at work on his farm cutting briars near the public highway, when Berry Carpenter came up. Lee Carpenter's boy, aged fourteen or fifteen years, was the only eye witness. The boy says Berry Carpenter came up and said to his father: 'G-d d-n you, I am going to put a hole through you' and immediately drew a pistol and fired one shot, which took effect in the heart, killing him instantly. Lee was sitting upon the fence when the shot was fired. Both men have families, and Berry's family is left with but little property. Immediately after the shooting Berry Carpenter fled. He met Adam Boner about two hundred yards from the place of the killing, and upon being asked what he had done, said 'I have shot Lee.' Boner attempted to stop him, when Berry drew his revolver on him and Mr. Boner permitted him to escape. The facts above states are reliable. The statement comes from the one of the most responsible citizens of Harrison county...

"Harrison County officers, who were in the city this morning in pursuit of the murderer, stated that sometime ago a bundle of switches and a note of warning were left on Berry Carpenter's door step by the Harrison county Regulators, or "Knights of the Switch," as they are called. They stated that Berry was not liked in the neighborhood, being regarded with great ill-will by many or account of reports circulated in regard to an alleged improper intimacy between himself and his daughter, and that he accused his brother Lee of giving currency to these reports and instigating the action of the Regulators, and it was this that led him to commit the murder...

"Secreted in New Albany. While at least two hundred citizens of Harrison and Floyd counties were searching the country yesterday afternoon for Berry Carpenter, the murderer, he was in this city. About 3 o'clock he arrived at the residence of Mr. George Fisher, in the Lower Albany suburb, and remained there until about 5 1/2 o'clock-two hours and a half-no one being informed of his presence, though he told the family he had shot and killed his brother Lee. The daughter, about whom the bad reports had been put in circulation which led to the killing, was at Mr. Fisher's. The murderer told her and Mr.Fisher's family...

"His side of the story as follows: I was walking along the road Lee was in the field at work with the scythe. He commenced abusing me and said, 'I'll cut you in two with the scythe. No, I won't do that, but I'll mash your d-d head in with a rock, you d-d scoundrel.' Then he picked up a large stone and started for me. I told him to stand back or I would hurt him; but he came on with the stone in his hand drawn to strike me, and then I pulled out my pistol and shot, but I did not mean to hit him. I shot to keep him from killing me with the stone.' Mr. Fisher was in the house with the murderer most of the time he was there. While there Berry gave his daughter, who was temporarily staying with Fisher, ten dollars, saying, "take this and good bye, for you will never see again." He then started toward, the Budd Road, on which road he was seen about 8 o'clock at night, in the neighborhood of Mr. Hancock's residence. Before leaving he told Mr. Fisher he was going to Corydon to surrender himself to the officers. 'I will not be taken by those country people who are searching for me, for they will mob me,' he remarked, as he left...

"The Story of Incest. Mr. Fisher made a statement in relation to the charge of incest against Berry Carpenter and his daughter. He says the story originated first with Carpenter's wife and was afterwards circulated by Mrs. Carpenter's sister, and thus became and has since continued the neighborhood talk. 'The story is utterly false," said Mr. Fisher. 'The girl never gave birth to a child, and is willing to submit to the examination of competent physicians to prove this. Both herself and her father say this, and her mother now states that the report is false, and that she was angry when she first started it. The girl is nearly killed over this story which has been so freely circulated about her. But it is false and can be proved so.' The girl is Carpenter's daughter by his first wife. Carpenter and his wife, Mr. Fisher stated, had quarreled over this incest story and he left home, taking the girl with him. They went to Memphis, then to Cairo, and finally into Pike County, whence they returned a few weeks ago, since which time she has been at Mr. Fisher's house. After Berry's return he and his wife became reconciled, she taking back and denying all the stories about the incest told by her sister or herself. This is Mr. Fisher's statement...

"Not Yet Arrested. Up to 3 o'clock this afternoon Carpenter had not been arrested, nor had he given himself up to the officers. The belief is that he crossed the Ohio river last night in a skiff and has made good his escape. Some people think that despairing of Escape Carpenter has gone to some secret place known to him in the knobs and committed suicide. There is not much probability in this latter theory. The excitement against Carpenter continues intense in Posey township. Men armed with guns have been on the search for him ever since he committed the crime and no one doubts that, if caught, he will be immediately shot or hanged. There was a strong feeling against him in the neighborhood before the murder, and the bloody crime has intensifies it...

"Carpenter's wife is in the deepest distress over the terrible murder and frightful end of their family difficulties. Sheriff Meyer, of this city, was at her house last night. He found her walking the floor, wringing her hand and weeping and moaning piteously. She has six children and they are but poorly provided for. Mr. Meyer says that Carpenter was seen about 9 o'clock last night near the Blunk knob, apparently making his way toward the Ohio river. The officers believe he daughter will soon disappear and follow her father, as they had a long secret conference at Mr. Fisher's yesterday afternoon...

"Two Hundred Dollars Reward has been offered by the Commissioners of the Harrison county for the arrest of Berry Carpenter, and his reward is stimulating the officers to renewed exertion to try to secure his capture. The probabilities, however, are that the made good his escape into Kentucky last night." [2]

"The Carpenter Fratricide. Some Facts in Relation to the Killing that should be published. In Justice to Berry Carpenter...

"There is such a thing as provoking a good man, whose whole life has been without spot or blemish, to the perpetration of a great crime. Berry Carpenter, who last week slew his brother, Lee Carpenter, was not a said, but facts gathered by a Ledger-Standard reporter from those who have known him all his life, prove that he is not a bad man. His habits were always good, his morals fairly averaged with those of his neighbors. He was always peaceable, of genial temper and very sociable. He was industrious as well as genial, and a most indulgent husband and father. His wife and children were provided with all they desired when he had the money to purchase what they wanted...

"Berry Carpenter's daughter by his first wife is between eighteen and nineteen years old. She is of medium height, slender build, graceful motion, and very handsome features. But she is an ingenuous country girl, knowing nothing of the ways of the city or the world, having lived all her life in an obscure rural district. to this child of his first wife - his youthful love - Berry Carpenter was deeply attached, seeing duplicated in her face the lines of loveliness that, in her mother's face, had captivated his young heart. The child, after the death of her mother, was taken to the home of her grandmother, where she remained until two years after the second marriage of Berry Carpenter. Then she returned to her father's residence, where she remained until about six weeks before the fatal catastrophe that made her father a fratricide...

"During her stay with her step-mother they always got on pleasantly together. There was no trouble in the family until on one night during last winter. A revival of religion was in progress at Elizabeth, and these revival meetings had been attended by Berry Carpenter and members of his family. One night Mrs. Carpenter did not want her step-daughter to go to the church; but she had become interested in the meeting and asked her father to permit her to attend. He told her she could do so if she desired. The Mrs. Carpenter and the girl got into the sleight with Bery to start to church. But Mrs. Carpenter was very angry, for she desired the girl to stay at home. She appealed to Berry to make her remain at home. Berry replied, 'no, let her go; she wants to go and shall to do.'...

"This greatly angered Mrs. Carpenter, and she leaped out of the sleigh with an accusation against the girl and her father - the product of anger and fiery temper. This accusation was overheard by Mrs. Carpenter's sister, and she told it to a brother-in-law of Carpenter - his enemy - and he and the wife's sister put it into circulation in the neighborhood. Finally, the report came to Berry's ears, startling and angering him to an intense degree. By this time the report was the talk of the entire neighborhood. 'It was as false as hell,' Mrs. Carpenter now says. 'There was not the slightest foundation for it. I spoke in anger and should not have said what I did, for there was not a word of truth in it.' This Mrs. Carpenter has recently repeated to many persons. And after the fratricide she had the unhappy daughter taken to her house, where she now is...

"Berry Carpenter came to this city after hearing this report and went to the residence of hi brother, ex-chief of police William Carpenter, to whom he related the report, telling him he had determined to take his daughter to the residence of her uncle in Spencer county and leave her there and remain away himself until the report blew over. He was in a half crazed condition of mind. The character of his child had been most vilely traduced - his own reputation blackened by the reports of incest. He said to his brother that these reports must and should be stopped. He said he had notified the persons most active in circulating them never to put foot upon his farm; if they did so he would kill them. Meantime he had quarreled with his wife over the reports and had left her...

"He took his daughter and left a he had proposed to his brother to do. He returned on the Sunday preceding the killing. He went to see his wife. She declared to him she never believed the report about his daughter and expressed the deepest sorrow for what she had said. They then settled their troubles, and Berry tarted to New Albany for his daughter, who was at the residence of Mr. George Fisher, for the purpose of taking her back to their home. On the way to the city he passed the farm of Lee Carpenter. Lee's wife had been very severe on Berry and his daughter. Berry referred to this in hi talk with Lee, and denounced Lee's wife very bitterly. And this is Berry's story of what followed: 'Lee was in the field. He had a brier scythe in his hand. He started for me, but said he would not use the scythe but would take a stone and mash my head. He came over the fence at me with the stone in his hand. I told him to stand back, but he came right on. I then drew my pistol and fired. I did not mean to shoot him but only to intimidate him. In his movement he came within range of the pistol and was killed. I was very much excited. My mind was distracted with the trouble that was upon me; but God knows I did not intend to kill my brother." [3]

"Carpenter Fratricide. Proceedings in the Trial of Berry Carpenter at Corydon for the Murder of his brother, lee Carpenter...

"In the Carpenter fratricide trial at Corydon, Charles Carpenter, Dr. Samuel Wolfe, Pauline Carpenter, Arnold Brown, Laura Carpenter, William Jones, Anthony Jones and William Dodds have testified for the State. Charles and Laura Carpenter are the son and daughter, and Pauline Carpenter the wife of the murdered man, Lee Carpenter...

"Charles Carpenter and the defendant, Greenberry Carpenter, were the only eye witnesses of the tragedy. Charles Carpenter testified as follows: 'My father and myself were cutting grass and briers along a lane fence on my father's farm, when Greenbery Carpenter came up and my father said to him: 'I see you have gotten back.' 'yes' replied uncle Greenberry. 'Why did you do that dirty trick with the children?' asked my father (referring to a time when defendant came to his house and took away certain barrel hoops.) 'Because they were mine,' replied Berry. 'I heard you said you was going to give me a d-d good thrashing,' said my father. 'I did,' replied Berry. 'I heard you said I had cheated you out of a sixty dollar horse.' 'Yes,' replied Berry, 'I said that, and you swindled Mary (defendant's wife) out of five or six hundred slaves.' My father then said,'you are a G-d- liar.' My father was on the fence when he said this, and Uncle Berry said 'if you move I'll shoot a hole in you before you know it.' My father then made a movement as if to get down from the fence, and at that instant uncle Berry shot him.' On cross examination the witness admitted he had been drilled to testify as he had done by John Villier, a brother of Lee Carpenter's wife...

"The defense is that the killing was done in self defense. It is said that the feeling at Crydon since the commencement of the trial has grown strongly in favor of the defendant, and the general impression is that the State has not made out the strong case that was expected. The case will probably go to the jury on Thursday. The witnesses for teh defense were put upon the stand today. The defense is being very ably managed by W.N. And R.J Tracewell and Maj. Jones. Prosecutor Zenor has displayed rare ability so far in the trial." [4]

New Albany Ledger, Tuesday December 13, 1881, New Albany Indiana

"Goes Up for Life. The Verdict in the Berry Carpenter Fratricide Case at Corydon. The trial of Greenberry Carpenter, for the murder of his brother, Lee Carpenter, terminated in the Harrison circuit court at Corydon yesterday forenoon at 11 o'clock, after occupying the time of the court and jury for eleven days from first to last. The defendant was indicted for murder in the first degree. The verdict of the jury was as follows:..

"We, of the jury, find the defendant guilty as charged in the indictment, and fix his punishment at confinement in the state prison for life."...

"The defendant received the verdict with surprise though without the betrayal of particular emotion beyond a pallor that overspread his face. He believed that at the worst of the verdict of the jury would not be greater than manslaughter. His counsel, Messrs. Tracewells, Jones and Douglass gave notice that they would make a motion for a new trial and asked time to prepare the necessary papers, which was granted by Judge Ramsey. Failing to obtain a new trial the case will be carried to the Supreme Court....

"The trial was one of the longest and most warmly contested that has taken place in Harrison county for many years. The attorneys for the defendant made a able a defense for their client as was ever made in a Harrison county court. Prosecutor Zenor and his assistant, Judge Denbo, also managed the case for the State with great ability. Judge Ramsey's rulings were highly complimented for their impartiality and correctness. The jury was composed of good men. There fore the defendant had a perfectly fair and impartial trial. The argument of Hon. W.N. Tracewell, for defendant, is said to have been as powerful as appeal as was ever made to a Harrison county jury; and Prosecutor Zenor's address to the jury is also spoken of a an exceedingly able and logical argument...

"Berry Carpenter's fate for life is probably fixed. But he will not have long to serve in the penitentiary. He is now far advanced in consumption, and the end of his fatal disease will be hastened by confinement in the prison. The citizens of Corydon speak in high terms of the fidelity shown the prisoner throughout his trial by his half-brothers Capt. Ad Carpenter and Ex-chief of police William Carpenter, of New Albany, both of whom, while deeply deploring the fatal meeting that ended in the killing, did all in their power to save their unfortunate half-brother.[5]

Son of Jacob and Mary "Polly" Kerr Carpenter, married twice: Susanna Morris, married 1862, 1 child, daughter Malinda E Carpenter, b. abt 1864. Susanna died soon after. Second wife: Mary E Bowling, daughter of Thomas J Bowling and Elizabeth Evans. Had 6 children.

In June of 1881, Greenberry shot and killed his brother, Lee, in Harrison County, Indiana. He went on the run, then turned himself into his brothers-in-law who turned him over to the authorities. He was tried and sentenced to life in prison. He died on the 8th of Feb, 1889, while still incarcerated. He bodied was interred in Hopewell Cemetery, Floyd Co. Indiana. He shares a marker with his mother.

New Albany Daily Ledger Standard Dec 4, 1875
This morning at an early hour Coroner Penington was informed that the body of a man had been found in the river a few feet above the lower stage plank that leads to Reamers Wharf - boat. The man was laying with his face downward and partially buried in the mud. A Coroner's jury was immediately summoned, and from the testimony taken we are able to deduce the following facts: The body was at once recognized as Henry Carpenter, an old gentleman well known to many of our citizens who mysteriously disappeared from home last Tuesday night. On Wednesday Mr. James R Appleby found a hat a short distance below where the body was found this morning. When last seen on Tuesday evening he was under the influence of liquor, and it is thought that sometime during the night he attempted to get on the wharfboat , accidentally fell overboard and drownd.

"Parties reached the city about noon today from Harrison county, bringing partial particulars of one of the most shocking murders that has occurred in this part of the state in many years. Berry Carpenter and Lee Carpenter are brothers. They are farmers and reside in Posey township, Harrison county, between Bridgeport and Elizabeth. They are both brothers of William Carpenter, ex-chief of police and half-brothers of Capt. Ad. Carpenter, of this city.
